Conditions that travel with reinstatement

Required program: Court-approved chemical dependency program (second or subsequent offense, SDCL § 32-23-3); no statutory first-offense education program located

SDCL § 32-23-3 conditions a second offender's court-permitted driving on successful completion of a court-approved chemical dependency program and proof of financial responsibility. For a first offense, § 32-23-2 lets the court permit driving for attendance at counseling programs, treatment, or aftercare but names no required program. The DPS Restricted Work/School Permit application requires a Chemical Dependency Certificate for out-of-state second or subsequent DUI convictions.

Upon the successful completion of a court-approved chemical dependency program, and proof of financial responsibility pursuant to § 32-35-113, the court may permit the person to drive for the purposes of employment, 24/7 sobriety testing, attendance at school

Driving during the suspension: Court-issued limited driving permit (SDCL § 32-23-2) and DPS Restricted Work/School Permit (restricted license under SDCL § 32-23-11 and ARSD art. 61:19)

Under § 32-23-2 the court may, in its discretion and upon proof of financial responsibility, issue an order permitting driving for employment, 24/7 sobriety testing, school, child care, health, court/probation appointments, counseling, treatment or aftercare; under § 32-23-23 such a permit is conditioned on total abstinence and 24/7 program participation where the person had a prior DUI within ten years or a BAC of 0.17 or more. DPS's Restricted Work/School Permit application requires an SR22 filing for DUI applicants and proof of 24/7 enrollment for second-or-subsequent or 0.17-plus cases; ARSD 61:19:02 requires employer affidavits and no reasonable alternative transportation.

If applying because of a Driving Under the Influence or No Insurance conviction, an SR22 filing will need to be received from your insurance company as part of your application.

An interlock is one of six testing methods a 24/7 Sobriety Program participant may be placed on under ARSD 2:06:02:03, available if a device is obtainable from a vendor, the participant holds a valid license or work permit, and has proof of financial responsibility. Fees are set by ARSD 2:06:03:05 ($40 enrollment; $20 per periodic inspection).
