SR-22 Requirements After a DUI by State
An SR-22 is not insurance. It is a certificate an insurer files with the state to prove a driver carries the liability coverage the state requires, and it must stay on file for a set period — a lapse can trigger a new suspension. Whether a DUI triggers the filing at all, which form is used, and for how long, is set by each state's financial-responsibility statute or licensing agency, and the answers differ more than most guides admit.
Every row below comes from the verified record behind that state's page: the statute or agency page is cited there, with the date it was last checked. Where a state uses a different form (Florida and Virginia's FR-44, North Carolina's DL-123), the row says so.
- 31
- Require a filing after any DUI
- 2
- Require it only after a repeat offense
- 18
- Do not require a filing
- 2
- Use an FR-44 instead of an SR-22
Most common filing period among states that require one: 3 years.
"Required" means the state conditions reinstatement after a DUI on a financial-responsibility filing. "Repeat offenses only" means a first offense does not trigger it. "No" means the state's reinstatement requirements or financial-responsibility statute do not include it — the state page cites the enumeration relied on.
