How to get your license back after a DUI in Massachusetts

Getting a license back after a DUI is an agency process, not a court one: the steps below are the ones the Massachusetts Registry of Motor Vehicles (RMV) lists, in its order, each quoted from the agency's own page. Requirements differ by offense, blood-alcohol level, refusal, and prior record; the state's wording controls.

    Schedule and prepare for the virtual hearing

    The hearing is scheduled through myRMV (Appointments, then Make or Cancel a Hearing Appointment). Required documents are uploaded when scheduling: the Ignition Interlock Operator's Affidavit, the Other Licensed Resident affidavit for each licensed person in the household, and the Vehicles Not in Possession affidavit if applicable. The RMV notes the mandatory Interlock Program period is a minimum of 730 days and that suspended, expired, inactive, or hardship-restricted time does not count.

    Pay reinstatement fees

    Fees are paid through myRMV, the RMV Contact Center, or an RMV Service Center; the RMV states fees cannot be waived, must be paid all at once, and no payment plans are offered. Under M.G.L. c. 90, § 33(36) the fee after a c. 90, § 24 suspension or revocation is $500 ($700 and $1,200 for specified repeat revocations); the RMV's general reinstatement page states fees range from $100 to $1,200.

    Apply for IID removal, obtain a license without the T restriction, then have the device removed

    Removal requires a minimum of 730 days in the program and no infractions or violations in the preceding 6 months while actively in the program. Removal is requested through the IID Service Request Portal or an IID hearing; on approval the T restriction is removed when a new license copy is issued (a $25 duplicate fee applies), after which the vendor removes the devices.

Conditions that travel with reinstatement

Required program: 24D Program (Driver Alcohol Education Program); RMV-required drug or alcohol counseling and/or education program approved by the Department of Public Health

The RMV's First Offense (24D) OUI Hardship License Criteria (DCU107) require documented enrollment in the court-ordered 24D Program, also called the Driver Alcohol Education Program. The RMV's 'Required classes and programs' page states the RMV may require attendance at a drug or alcohol counseling and/or education program approved by the Department of Public Health, and that proof of enrollment or completion must be brought to an RMV hearings officer during a reinstatement hearing. For multiple offenders, DCU109 requires proof of completion of a 2-week in-house program (second offense) or 90-day in-house program (third and fourth offenses) with a discharge summary and aftercare compliance.

24D Program, also called the Driver Alcohol Education Program.

Driving during the suspension: Hardship license (conditional 12-hour/day hardship license; 'HT' Hardship and Interlock restriction when an IID is required)

Per the RMV IID guide, an operator meeting the hardship requirements on the OUI offense is issued a conditional twelve hour/day hardship license with the Hardship and Interlock ('HT') restriction. DCU107 (first offense 24D) conditions include no operation since the suspension took effect, a 24D disposition, completion of other active suspensions, documented enrollment in the 24D program, an employer letter (or proof of self-employment or third-party documentation) not more than 30 days old stating the need and hours, and proof regarding public transportation; the RMV may only grant an identical 12-hour, 7-day license and issuance is at the RMV's reasonable discretion. First offenders with a breath test of .15 or greater must install an IID as a condition of the hardship license. DCU109 (multiple offense) adds minimum time served (e.g., 3 months into a 1-year suspension for work/education hardship, 6 months for general hardship), proof of treatment completion, and a probation compliance letter.

Any operator meeting the requirements for hardship on the OUI offense will be issued a conditional twelve hour/day hardship license with the Hardship and Interlock (“HT”) license restriction.

When the interlock can be removed

Compliance-based, authorized by an RMV Hearings Officer. The RMV IID guide states the restriction is not automatically removed and all operators must apply to a hearings officer to have the IID removed. Eligibility for multiple OUI offenders requires completing the 2-year IID program and having no program infractions or violations for 6 months before the removal request (excluding inactive or suspended time); if the IID was required on a hardship license, the full hardship term plus 2 years after full reinstatement must be served. If the restriction was originally less than six months, the hearings officer reviews the entire period and extends the restriction six months from the most recent infraction. The RMV states the requirement is never based on time installed but on the statutory suspension/revocation periods. Unauthorized removal triggers immediate suspension with no program credit.
