Driving after a DUI in Maryland: the Interlock Restricted License

In Maryland, a first-offense DUI driver can apply for an Interlock Restricted License with no waiting period. The licensing agency issues it. An ignition interlock is required; an SR-22 filing is not required; DUI-program participation is not required. The deadline to request a hearing on the administrative suspension is 30 days from the notice.

Most states let a first-offense DUI driver back on the road before the suspension ends — under a restricted privilege that goes by a different name in almost every state, that usually starts only after a set number of days with no driving at all, and that comes with its own conditions. The rules below are the ones the Maryland Department of Transportation Motor Vehicle Administration (MDOT MVA) state, each quoted from the source.

The first days: the administrative suspension and the hearing deadline

In most states the licensing agency suspends the license at arrest, separately from any court case, and the driver has a short window to request a hearing on that suspension. Missing it lets the suspension take effect without review.

The officer confiscates the license, serves an Order of Suspension (DR-015A) and issues a temporary license valid for 45 days. The MVA states a driver may be eligible to join the Ignition Interlock Program if the license is not already suspended, revoked, canceled or refused and, within 30 days of the Order of Suspension, the driver installs an interlock device, turns in the license (or signs a statement) and enrolls with the MVA; the driver 'may also choose the program instead of serving a suspension, if eligible.' Where and when it allows driving

The Interlock Restricted License allows driving only in a vehicle equipped with an ignition interlock device (no purpose or hour limits stated by the MVA; the vehicle must be driven at least 50 times in a monitoring period). An ALJ modification or restricted license under § 16-205.1(o) (0.08-0.14 only) may be granted where the license is required in the course of employment, to attend an alcohol prevention or treatment program, where no alternative transportation to work exists and the ability to earn a living would be severely impaired, to obtain necessary health care, or to attend an educational institution.
