Suspended license in Iowa: points, other causes, and how to reinstate

Iowa does not use a points system; it counts convictions instead. A Driver Improvement Program can be taken instead of, or to end, a suspension, not more than once within a two-year period. The fee to reinstate after a suspension that is not alcohol-related is $20.

A DUI is only one of the ways a license gets suspended. Points from ordinary tickets, an unpaid ticket, a lapse in insurance, unpaid child support or a missed court date each carry their own suspension and their own path back. The rules below are the ones the Iowa Department of Transportation (Motor Vehicle Division) states, each quoted from its page or from the statute.

How the points system works

This state does not use a points system. What it uses instead — a count of convictions inside a period, a driver-improvement rule or a habitual-offender rule — is described below in the state's own words.

Iowa has no point system. The Iowa DOT counts convictions: a 'habitual violator' is a person convicted of three or more countable moving violations committed within a 12-month period (minimum 90-day suspension, rising to one year for seven or more), a 'serious violation' (speeding 25 mph or more over the limit, a first unlawful school-bus pass, or a moving violation contributing to a fatal crash) brings its own suspension, and a 'habitual offender' with three major convictions in six years, or six moving violations in two years, is barred.

Points period stated by the agency: 1 year. Moving violations count toward a habitual-violator suspension when committed within a 12-month period (dates of offense, not conviction); six moving violations within two years, or three major offenses within six years, count toward a habitual-offender bar. The DOT states completion of a driver improvement program, probation or a suspension does not clear the record of violation entries.

The dates the offenses occurred, not the dates you are convicted of traffic violations, are considered when determining how many violations have taken place in a specified time period.

Iowa has no points to reduce; the program is offered in lieu of suspension. Under 761 IAC 615.27, the DOT may require a habitual violator (three countable moving violations in 12 months), a driver convicted of speeding 25 to 29 mph over the limit, or a first-offense school-bus violator to complete an approved driver improvement program at the driver's own expense instead of serving the suspension; the DOT enrolls the driver automatically and the provider schedules attendance. Completion is followed by a one-year probation during which one moving-violation conviction leads to suspension for the original period; failure to attend brings the original suspension. Completion does not clear the driving record.

Habitual Violator (three or more moving violations in 12 months)

Serious Violation

Serious Violation If you are convicted of, or pled guilty to, speeding 25 miles or more over the legal speed limit, a first offense of unlawfully passing a school bus, or a moving violation that contributed to a fatal motor vehicle crash (including out-of-state violations).

Habitual Offender (barred)

You will be barred for two to six years if you receive three or more of any combination of the following convictions in a six-year period: Manslaughter with a motor vehicle.

Suspension for Non-payment of Fines

If your license was suspended, you will need to schedule an appointment to come in to the DMV to reinstate your privileges, pay a $20 reinstatement fee and a $10 duplicate license fee.

Suspension Due to an Accident (financial responsibility)

If you cause injury or property damage exceeding $1,500 to the other party, you must show proof of insurance. Otherwise, your license will be suspended.

Suspension or denial for incapability

615.7(2) A suspension or denial under this rule will remain in effect until the department receives satisfactory evidence that the licensee has been restored to capability.

Suspension for unlawful use of a license

The department may suspend a person’s license upon receipt of a conviction or written law enforcement report that the person has permitted unlawful or fraudulent use of the license. The suspension period will be at least 30 but no more than 60 days.

Reinstating after a non-DUI suspension

Reinstatement fee: $20. Iowa Code § 321.191(8) sets a $20 fee for reinstatement of a license canceled, suspended, revoked or barred after notice and opportunity for hearing; reinstatement after an incapability suspension is without fee. The DOT's non-payment page adds a $10 duplicate license fee, and its habitual-violator and TRL pages state the license fee is paid with the $20.

  2. File proof of financial responsibility (SR-22)

    Proof of financial responsibility is required from the first day of the suspension or revocation and for two years; the insurer files an SR-22 with the DOT, or a $55,000 bond, cash or securities, or an employer SR-23 may be used.

  3. Pass any required exams

    The DOT reinstates when the sanction has ended and the person has complied with the notice terminating the sanction and completed any required driver license examinations; if more than a year has passed without a valid license, knowledge and driving tests are required.

Driving during a non-DUI suspension

Available · Temporary Restricted License (TRL) / work permit. An Iowa resident at least 18 whose privileges are revoked, suspended or barred may qualify for a TRL to drive for employment, continuing health care, child care needed for employment, continuing education, substance-use treatment, court-ordered community service and probation or parole appointments. For a non-OWI sanction the driver files Form 430100, proof of financial responsibility (SR-22) and pays any civil penalties; on approval the driver passes required exams and pays the $20 reinstatement fee and license fee at a DMV. A driver suspended under 761 IAC 615.26 (remedial driver improvement for drivers under 18) is not eligible.

Questions about a suspended license in Iowa

Does Iowa have a driver's license point system?
No. Iowa Code § 321.210 authorizes suspension of an 'habitual violator of the traffic laws' and for a 'serious violation', and 761 IAC 615.6 defines a habitual violator as a person convicted of three or more moving violations committed within a 12-month period, with minimum suspensions of 90 days for three convictions up to one year for seven or more.
Can an Iowa driver take a course instead of a suspension?
The Iowa DOT states eligible drivers are automatically enrolled in a driver improvement program in lieu of suspension after three countable moving violations in 12 months, speeding 25 to 29 mph over the limit, or a first school-bus offense; under 761 IAC 615.27 this is allowed once in two years and is followed by one year of probation.
