Suspended license in Idaho: points, other causes, and how to reinstate
In Idaho, the first points threshold is 12 points within 1 year: 30-day suspension. A Defensive Driving Course (DDC) / Traffic Safety Education Course (TSC) removes 3 points, once every three (3) years, whether the reduction comes from a DDC or a TSC. The fee to reinstate after a suspension that is not alcohol-related is $25.
A DUI is only one of the ways a license gets suspended. Points from ordinary tickets, an unpaid ticket, a lapse in insurance, unpaid child support or a missed court date each carry their own suspension and their own path back. The rules below are the ones the Idaho Transportation Department (ITD), Division of Motor Vehicles – Driver Services states, each quoted from its page or from the statute.
How the points system works
Most states assign points to moving violations and suspend the license when the total inside a set window crosses a threshold. The threshold, the window and how long each violation keeps counting are all set by the state.
Idaho's violation point count system assigns 1 to 4 points to each moving violation conviction entered on the driver's record; all driving records are continuously evaluated and the department suspends driving privileges for the accumulation of points (12 to 17 in 12 months, 18 to 23 in 24 months, 24 or more in 36 months).
| Points | Within | Consequence | Source |
|---|---|---|---|
| 12 points | 1 year | 30-day suspension | adminrules.idaho.gov |
| 18 points | 2 years | 90-day suspension | adminrules.idaho.gov |
| 24 points | 3 years | Six-month (180-day) suspension | adminrules.idaho.gov |
Points period stated by the agency: 3 years. Points count toward suspension within rolling 12-, 24- and 36-month periods; ITD's guide states an Idaho driving record covers the most recent three years of history for a standard record, and that a defensive driving course removes points from the count but does not remove convictions from the record.
“Twelve Points. When a driver accumulates twelve (12) or more points in any twelve (12) month period of time, the suspension period will be for thirty (30) days.”
“Completion of a DDC does not remove convictions from the driving record.”
| Violation | Points |
|---|---|
| 49-654 Basic rule and maximum speed limits (other speeding violations: 3 points; 16 mph or more over the posted maximum: 4 points) | 3 |
| 49-657 Work zone speed | 4 |
| 49-1401(3) Inattentive driving | 3 |
| 49-801 Obedience to and required traffic control devices | 3 |
| 49-807(3) Failure to yield – signed intersections | 3 |
| 49-658 School zone speed limit | 3 |

The statute: Idaho Code § 49-326(1)(i), (2)–(3)
“(i) Has a driving record which shows a violation point count of twelve (12) or more points in any consecutive twelve (12) month period; (j) Is an habitual violator of traffic laws”
Traffic school and point reduction
| Course | Defensive Driving Course (DDC) / Traffic Safety Education Course (TSC) |
|---|---|
| Effect | Removes or prevents points |
| Points removed | 3 |
| How often | once every three (3) years, whether the reduction comes from a DDC or a TSC |
Under IDAPA 39.02.71.400, three points may be removed from the violation point count on completion of an ITD-approved defensive driving class; a city-sponsored Traffic Safety Education Course, offered at roadside at the officer's discretion, removes the points (1–4) for that citation. Points may be removed only once every three years, the citation must be paid first, and completion does not remove the conviction from the record. Course costs are set by the provider; ITD lists the approved providers and states tuition ranges from about $18 to $60.
“Three (3) points may be removed from an Idaho driving record upon the driver’s completion of an approved defensive driving class or points may be removed from a traffic violation upon the driver's completion of an approved traffic safety education program. Points may only be removed from a driver’s”
Other reasons a license is suspended, and what ends each one
These are the causes the licensing agency itself lists on its suspension pages, with what it requires to lift each one. Court-imposed suspensions and DUI suspensions are covered on the state's DUI pages.
| Cause | What the agency states | To reinstate | Fee |
|---|---|---|---|
| Points (Non-CDL mandatory withdrawal) | 12 to 17 points in 12 months: 30-day suspension; 18 to 23 in 24 months: 90 days; 24 or more in 36 months: 180 days. A Restricted Driving Permit is allowed. | Reinstatement application and a $25 fee to ITD; no interlock or SR-22 is required for a points suspension. | $25 |
| No Insurance conviction/suspension | A first offense for failure to provide insurance is an infraction carrying a one-year suspension; a second offense within 5 years is a misdemeanor carrying a three-year suspension. An SR-22 must be maintained for the length of the suspension. | Reinstatement fee ($85 for a no-insurance conviction) and an SR-22 maintained for the suspension period; if the SR-22 lapses the suspension is reactivated until the SR-22 and fee requirements are met. | $85 |
| NRVC (Non-Resident Violator Compact) – not paying traffic ticket fines from out of state | An indefinite suspension, with no Restricted Driving Permit, until the out-of-state citation is resolved. Under Idaho Code § 49-328(3) an Idaho license is not suspended for failure to pay an Idaho infraction penalty. | Resolution of the out-of-state citation and a $25 reinstatement fee. | $25 |
| Family Responsibility / Child Support | Listed by ITD among withdrawal actions carrying the $25 reinstatement fee (violation of child support payment or visitation order or subpoena for paternity). | Release of the child support action and a $25 reinstatement fee. | $25 |
| Reckless driving; fleeing or attempting to elude a peace officer | Under Idaho Code § 49-326(1)(f), privileges are suspended 30 days on conviction, 90 days for a second conviction within two years, and one year for a third within three years of the first. | Reinstatement application and fee; ITD's guide lists reckless driving and eluding among the $85 reinstatement-fee actions. | $85 |
| Leaving the scene of an accident | Conviction for leaving the scene of an accident involving vehicle damage, or resulting in injury or death, carries a one-year revocation under Idaho Code § 49-326(1)(l)–(m). | Reinstatement application and fee after the revocation period; ITD's guide lists leaving the scene among the $85 reinstatement-fee actions. | $85 |
| Medical/Visual (incompetent to drive) | The department may suspend or revoke where the driver is incompetent to drive, including conditions causing lapses of consciousness or control, or visual acuity of 20/70 or worse in both eyes; the $25 reinstatement fee applies. | Physician or eye-specialist recommendation and, where applicable, passage of a skills test; $25 reinstatement fee. | $25 |
| Habitual violator | ITD's guide defines a habitual violator as a person who accumulates 18 or more points in 24 months or 24 or more points in 36 months; Idaho Code § 49-326(1)(j) authorizes suspension of an habitual violator of traffic laws. | As for a points suspension: reinstatement application and $25 fee. | $25 |

Reinstating after a non-DUI suspension
Reinstatement fee: $25. Idaho Code § 49-328(2) sets a $25 reinstatement fee; § 49-328(4) adds $60 after conviction for a traffic-related misdemeanor or infraction, which ITD's fee table shows as $85 for no-insurance, leaving the scene, eluding, reckless driving, driving without privileges and court suspensions. Points-based, medical, SR-22-lapse, unsatisfied-judgment and child support actions carry $25; alcohol actions carry $245 or $285. When there are several reasons for a withdrawal, only the single highest fee is collected.
“The application shall be in the form prescribed by the department and accompanied by a reinstatement fee of twenty-five dollars ($25.00) which shall be deposited in the state highway account.”
Wait for the suspension period to end or the reason to be resolved
The department reinstates on application when the period of suspension has expired or the reason for the suspension no longer exists.
“When the period of revocation, disqualification or suspension of a driver’s license has expired, or the reason for the revocation, disqualification or suspension no longer exists, the department shall reinstate the driver’s license or driving privileges on application of the driver.”
Submit the reinstatement application
A reinstatement application with any fees and documentation is required whenever the court or the department has taken a withdrawal action; ITD provides a paper reinstatement application and an online DMV portal.
“A reinstatement application along with any fees and/or documentation is required whenever the court or the department has taken any withdrawal action on a driving record.”
Pay the reinstatement fee
Fees may be paid online at the DMV portal, by mailing a check or money order to the department, or by card by calling Driver Services at (208) 584-4343; if there are multiple withdrawals the highest single fee is owed.
“Reinstatement fees can be paid by mailing a check or money order to the department or paid online with a credit or debit card at https://www.dmvonline.itd.idaho.gov.”
File an SR-22 if the suspension requires one
Various suspensions require an SR-22 for a length of time; since January 1, 2025 the insurer submits SR-22/26 information through the State of Idaho Insurance Verification System, and ITD offers a free status check.
“As of January 1, 2025, SR22/26 information must be submitted to the State of Idaho Insurance Verification System .”

Driving during a non-DUI suspension
Available · Restricted Driving Permit (RDP). ITD's Non-Commercial License Withdrawal Guide shows a Restricted Driving Permit is allowed (non-CMV only) for each tier of points suspension (12–17 in 12 months, 18–23 in 24 months, 24+ in 36 months), while an NRVC out-of-state unpaid-ticket suspension does not allow one. An RDP is issued by ITD on administrative suspensions; a Court Restricted License Permit is issued by the court on court-ordered suspensions.

Questions about a suspended license in Idaho
- How many points suspend an Idaho license?
- Under Idaho Code § 49-326(1)(i) and IDAPA 39.02.71.300, 12 or more points in any 12-month period brings a 30-day suspension, 18 or more in 24 months a 90-day suspension, and 24 or more in 36 months a six-month suspension. Moving violations carry 1 to 4 points; ordinary speeding is 3 points and 16 mph or more over the limit or work-zone speeding is 4.
- Can a defensive driving course remove points in Idaho?
- Yes. IDAPA 39.02.71.400 allows three points to be removed from the record on completion of an approved defensive driving class, or the points for one citation to be removed through a city Traffic Safety Education Course offered at roadside; a reduction is allowed only once every three years. ITD states the citation must be paid first and completion does not remove the conviction.
- What does Idaho charge to reinstate after a points suspension?
- Idaho Code § 49-328(2) sets a $25 reinstatement fee, and ITD's Guide to Understanding Driver Records lists $25 for points-based suspensions, with no interlock or SR-22 requirement. Court-conviction suspensions such as no insurance, reckless driving or leaving the scene carry $85, and alcohol actions $245 or $285.
- Can an Idaho driver get a restricted permit during a points suspension?
- ITD's Non-Commercial License Withdrawal Guide marks a Restricted Driving Permit as allowed for all three points-suspension tiers, and defines the RDP as a permit issued by ITD on administrative suspensions. The guide shows no permit for an indefinite Non-Resident Violator Compact suspension for unpaid out-of-state tickets.
- Does Idaho suspend a license for not paying a traffic ticket?
- Idaho Code § 49-328(3) states a driver's license shall not be suspended for failure to pay an infraction penalty, and licenses suspended before July 1, 2018 for that reason are reinstated without charge. ITD's guide still lists an indefinite suspension under the Non-Resident Violator Compact for unpaid out-of-state traffic ticket fines.
